But I'm not sure why most Americans tend to ignore the big elephant in the room.

Free Speech is not absolute at all in the USA. Or more precisely it means significantly different things than most people think.

Many things trump free speech in the USA. Or why do you think have abusive police officers started to listen to popular copyrighted music during their abuse incidents? On the loudspeaker, not on headphones.
