Nik@Popehat @mmasnick @nilay_patel I read the transcript. Refusing to answer the question could easily be "we have a team of people who moderate. I don't have our ToS in front of me. I'm not going to make our moderation team's job harder by making stuff up on the fly in the middle of the interview".
Elsewhere in the interview he said that Notes is covered by their ToS, and the interviewer said that his hypothetical would be banned by the ToS.
