A tax fraud case, if they can make one, seems like it could be on much more solid ground than the previous analyses I've seen, which seem to depend on having a federal crime, which may itself not rise to the level of a felony, magically make the state misdemeanor a felony.

New York has state income taxes too, and it would be pretty strange if the twice-impeached racist misogynist fascist idiot mobster cheated on federal taxes but stayed clean on state individual taxes. So even if the state law on falsification of business records becoming a felony if used to facilitate other crimes applies only to state crimes, it still applies because cheating on state taxes is a state crime.

BenVernia@jaykuo seems like a good theory. I’ve been struck by the lack of attention to the Nat’l Enquirer payoff for Karen McDougal, also arranged by Cohen. DOJ announced the deferred prosecution agreement in the same announcement as Cohen’s sentencing. Could some if the money have been for that?

Thanks for explaining the payments but I don't understand them? Why did they double the payment and add 60k on top? Was there more to the full payment or another tax dodge going on? That organization never just extra money.
