@Popehat help! opposing counsel just sent me an email claiming that my client isn't entitled to anti-SLAPP damages because the "opinions [my client] published were defamatory". Do you know what a defamatory opinion is?
@AustinB @Popehat Is it an opinion which implies false facts about someone? (Not a lawyer, although it's probably obvious from my question. 🙂)

@alx @AustinB @Popehat
Also NAL but... I think if you state it is an opinion then it can't be defamation.

If you say - I think InfamousUnknown is a jerk - I can't sue you legally.

If you say - InfamousUnknown absolutely killed baby seals with a gas stove, I saw it myself - and I can prove it wasn't true... I might have a case.

@InfamousUnkown @AustinB @Popehat What if you say "In my opinion, Popehat murdered JFK?" That implies a concrete fact with reckless disregard for the truth.

@alx @InfamousUnkown @AustinB @Popehat

That would be considered ridiculous and beyond the realm of belief. As old as he looks, Ken hadn't been born yet.
