SDNY Calls DOJ's Definition of the Espionage Act an "Academic Interest" - emptywheel

SDNY says that it's merely academic to a journalist whether the government might prosecute her under the Espionage Act for sharing already published information.

Area Substacker was NOT charged with espionage himself for printing Reality Winner’s stolen NSA reports proving DFG was lying about Russian hacking in 2016 presidential election, b/c he himself did not “steal”. GG blew the whistle on the whistleblower and DOJ was fine with calling RW’s crime “espionage” & protecting GG’s 1A rights, but YOU *could* be charged w/espionage for sharing an NYT article that reveals stuff Assange stole?
