Justices Alito et al have been imploring Americans not to lose trust in the SC simply because they don't agree w/ its rulings. But as legal scholar @RosenzweigP@mastodon, a card-carrying conservative who served as senior counsel in Kenneth Starr’s investigation of former President Bill Clinton, argues at #TheUnPopulist that the court is losing legitimacy because its cons are prioritizing ideology over their avowed commitment to neutral jurisprudence. #Dobbs was but one example. https://www.theunpopulist.net/p/hubris-on-the-high-court-is-leading?r=6jqoy&utm_campaign=post&utm_medium=web
Hubris on the High Court Is Leading to a Legitimacy Problem

Conservative justices have abandoned their commitment to neutral jurisprudence for the sake of ideology

@shikhadalmia That was a surprisingly good and on-point article, given Rosenzweig's bona fides. One thing he didn't do is bring up Bush v. Gore, which is really when all this trouble started.
@panamared27401 Thanks! I agree Bush v Gore didn't help but I also don't think it ineluctably put us on the current course. In any event, subscribe to The UnPopulist for more content like this. Its totally free. https://www.theunpopulist.net/

@shikhadalmia Ineluctably? Perhaps not. Had Democrats been able to reject Alito, who knows what might have happened? But what DID happen was Citizens United and Shelby County and Dobbs and a whole host of stare-decisis-defying lesser rulings that have lacked any basis in facts (including history and science) or common sense. "Originalism" is wankery.
@shikhadalmia The politicalization of the last 3 GQP appointments delegitmized this Court. Every precident was broken to weigh in on the seating 3 of the most unqualified justices ever selected! Holding a seat vacant for Gorsuch, shutting down an investigation into the allegation of sexual misconduct by Kavanagh and finally the blatant incompetence of Barrett slammed through prior to an election? Until this is addressed SCOTUS remains broken 💔
