Serious question -- who has physical custody of Donald Trump's tax returns rn? The IRS?
@kairyssdal Everyone has had them for a while. Now they can use them as evidence in Court.
Think of it as an ex-post facto Serach Warrant.

@tbapple @kairyssdal

and maybe they can be shared with NY AG.. ??? anyone know if that's possible??

@tdwllms1 @tbapple @kairyssdal
Legally, no. The AG will need to request them from the IRS and go through all the crap that congress had to go through... Having said that, some of his tax documents were picked up in the Mar-A-Lardo warrant and have already been requested by Letisha James.
@kairyssdal that's my understanding. In 2021 the IRS's office of legal counsel (olc) ruled Congress had a right to have trumps tax documents (which was blocked during Trump admin). Trump sued to block this and ended up at scotus, this ruling ends it
@kairyssdal The Treasury Dept. is the agency named in the lawsuits, so I would assume yes, it's the IRS.
@kairyssdal The IRS has everyone's tax returns.
@kairyssdal
One would assume. At least, I wouldn't bother taking custody of his version. "Physical custody" being a nebulous term these days.
@kairyssdal Wasn't the suit over whether the IRS could turn the documents over to Congress? If so, the inference is that the IRS is in custody now, right?
@michaeljrenner @kairyssdal
Kind, the law says the IRS shall turn them over if they are requested for congressional duties. In this case though, Chump and his legal team claimed they were not being used for congressional duties, instead Chump claimed they were requested for political reasons and as such congress had no right to them.

@kairyssdal Him, IRS, His Accountants, and potentially any other jurisdiction that he files income taxes in.

Most states require a copy of your federal return along with the state return, especially the ones that base their income calculation off federal taxable income.

@kairyssdal
The IRS and state tax authorities would have the tax forms that are filed, but there are lots of tax forms (worksheets) with much more detail that don't get filed with the return. Only Trump and/or his accountants would have those, unless they were submitted as part of an audit or something.
@kairyssdal The IRS would have a copy and could print it along with a transcript, which would have all income reported to the IRS under the SSN.
@kairyssdal Is "physical custody" still a thing in a world where most financial records are managed electronically?
@kairyssdal (1) Mazars (public accounting firm in the namesake of the SCOTUS case) (2) The IRS and states would have a transcript that can be requested (https://www.irs.gov/individuals/get-transcript). I would really prefer to see the full versions, however, including the white paper statement detail and attachments.
