The EU’s merger guidelines are currently under revision. We have already contributed to the public consultation. On 19 November 2025, we initiated a cross-party exchange in the European Parliament on the ongoing revision of these guidelines and joined forces with other civil society partners. Decoding the 2023 FTC and DOJ Merger Guidelines: Insights into Shifting Antitrust Enforcement

The 2023 Merger Guidelines were released on December 18, 2023, by the US Federal Trade Commission (FTC) and the Department of Justice (DOJ), the two federal agencies that enforce the US antitrust laws. These guidelines replace all prior versions of the agencies’ various merger guidelines.
