Over on Common Dreams today Michael Waldman, the President of the Brennan Center for Justice, (very) briefly touches on the election story much of the American media has already moved on from, but should keep folks worried about a close finish up at night - the infiltration of state and county election boards by pro-Trump, election-deniers in official positions; including in the important swing state of Georgia.

Is the US Ready to Defend Democracy From Rogue Election Officials?

"You may remember former U.S. President Donald Trump’s rally at Georgia State University on August 3. That was the speech in which he attacked Republican Gov. Brian Kemp, Secretary of State Brad Raffensperger, and, for good measure, Kemp’s wife. What was noteworthy, though, was the fellow Republicans he praised. He lauded three newly appointed members of the state election board. “They’re on fire. They are doing a great job,” he declared.

Three days later we learned why he was so effusive. The state officials announced a new rule to require county officials across Georgia to conduct a “reasonable inquiry” before they can certify results.

That is a permission slip for subversion. In May, a board member who oversees elections in Fulton County—home of Atlanta, the biggest Black-majority city in the state—refused to certify a primary result, and to press her case, she sued her own election board. It turned out she is an organizer for Cleta Mitchell, a participant in Trump’s notorious “I just want to find 11,780 votes” phone call to Raffensperger in January 2021."

To be clear, this is a very short piece in which Waldman really doesn't answer his own question in the title; but to be fair, I'm not really sure he (or anyone else for that matter) actually can. While board officials can't *legally* prevent the certification of an election because they feel a way, the only real remedy for this situation is an increasingly empowered and largely unaccountable American judiciary stacked full of fascists (at various levels.) It is not at all hard to imagine a situation where a close Harris victory is held up in the courts by plausible deniability and endless appeals, which in turn makes it at least *possible* that this election is ultimately decided by a 6-3 fascist high SCOTUS that already has a track record of "creatively interpreting" the law in favor of Trump and wealthy conservative donors.

Furthermore, we know already that Trump, supporters like Elon Musk, and the American fascist party are not above attempting to incite riots to increase their power and try to overturn an election. It's entirely possible that Downmarket Mussolini won't be relying on judges to hand him the election, and will attempt to use any confusion or delay in announcing the final results to secure power through violence and "boots on the ground." Absolutely none of this would be legal, but that hasn't stopped Trump in the past, and Biden's Department of Justice has no mechanism for charging fascists they *think* might be trying to illegally steal the election until they actually give it a go.

Is any of this going to actually happen? Quite frankly, I don't know. But given Trump's track record of literally trying to steal the 2020 election, the preparations Republicans loyal to his cause have already undertaken, and the powder keg deliberate fascist propaganda has created in American political life, I think you'd have to be a fool to bet against them at least trying it. And if that happens, I don't know if anyone can rightfully predict how that story ends.
