Yes, in fact, he might be the exception, I had neglected that the trial is really already finished. (As @Teri_Kanefield just so nicely explained in her #AppealsCourts 101*, an appeal would most likely result in him losing again.

Take out your notebooks. It is time for Appellate Law 101.
A trial court does two things: It applies the law and it finds the facts.
Generally the jury finds the facts and a judge then directs with applying the law.
Appellate courts are not fact finders. You don't get a new trial on appeal.
When appellate courts review the factual finding of a lower court decision, they look to see if sufficient evidence exists to support the jury findings . . .
