Today marks one year since the Supreme Court’s For Women Scotland judgement. The Supreme Court told us its ruling would not remove rights from trans people, but it has caused confusion, discrimination and its decision is bleeding across into other legislation with devastating effects.

We are pleased that, in re-writing it, there has been some recognition of how discriminatory, authoritarian and unworkable the previous draft of the EHRC Code of Practice was. But once again trans people's fates are being decided behind closed doors without us having any say.

Whatever happens next, Government must ensure that trans people are able to go to work and be part of our communities without being forced into segregated or unsafe facilities.

We want to hear from all workers who can speak to changes your employer has made to their policies or practices related to trans inclusion following the Supreme Court judgment. We must show the government the real-world impact on trans workers if they do not act quickly to fix the outdated regulations that mandate trans exclusion.

While the High Court dismissed trans workers’ concerns about privacy and outing as mere ‘gossip at work’, we know there will be real ramifications of forcing trans people to suddenly start using different facilities than those they have always used.
The law around trans inclusion at work is a mess. Workplace regulations from the 90s are being interpreted to mean that the total exclusion of trans people from gendered facilities like bathrooms and changing rooms is the only way - at great cost to employers and at even greater cost to trans workers, some of whom have already been forced to leave their jobs.
