I’m not criticizing the historians who are seriously pointing out the flaws in the conservative Originalist arguments—that’s a necessary form of chemo.
But our overall rxn is not outraged enough.
Future legal historians are going to refuse to believe their eyes.
Like, wasn’t there a whole revolution thing? How did one crank justice—who is a mediocre jurist and a tenth-rate historian—force judges to cite laws from 4 centuries BEFORE THAT REVOLUTION?
