In “Disorderly Content”, in the Wash L Rev, I argue that sexual CM functions very much like anti-vice policing, showing that queer & nonnormative sexual expression is coded as illicit in ways heterosexuality is not and showing how CM is far less about free speech values than a form of social control.

The radical anti-equality Alliance Defending Freedom thinks the 1A guarantees teachers a right to purposely misgender trans kids but does not guarantee teachers a right to mention they’re gay (“Don’t Say Gay” gag rules). The only 1A that exists for these people is as a tool to undermine civil rights for queer people.
