Workplace regulations from the 90s are being interpreted to mean that the total exclusion of trans people from gendered facilities like bathrooms and changing rooms is the only way - at great cost to employers and at even greater cost to trans workers, some of whom have already been forced to leave their jobs.
While the High Court dismissed trans workers’ concerns about privacy and outing as mere ‘gossip at work’, we know there will be real ramifications of forcing trans people to suddenly start using different facilities than those they have always used.
