Judge rules feds in Minneapolis immigration operation can’t detain or tear gas peaceful protesters

A U.S. judge has ruled federal officers in a Minneapolis-area immigration operation can’t detain or tear gas peaceful protesters who aren’t obstructing authorities, including when these people are observing the agents. U.S. District Judge Kate Menendez ruled Friday in a case filed in December on behalf of six Minnesota activists. Thousands of people have been observing the activities of Immigration and Customs Enforcement and Border Patrol officers enforcing the Trump administration’s immigration crackdown in the Minneapolis-St. Paul area since early December. Government attorneys have argued the officers have been acting within their legal authority to enforce immigration laws and protect themselves.

The 80-page ruling by US District Judge Kate Menendez bars #DHS & #ICE officials involved in Operation Metro Surge from “using pepper-spray or similar nonlethal munitions & crowd dispersal tools against persons who are engaging in peaceful & unobstructive protest activity.” The judge also prohibited federal agents from stopping vehicles following them, as long as those vehicles are maintaining a safe & “appropriate” distance.

The #Trump admin will likely seek to immediately appeal the decision. It has recently surged >2,000 #DHS officials in #Minnesota to purportedly conduct #deportation operations & pursue claims of fraud by members of #Minneapolis’ prominent #Somali community.

“There is no sign that this operation is winding down—indeed, it appears to still be ramping up,” Menendez wrote.

Menendez’ decision Friday came in response to an emergency request from #protesters who sued #ICE in December, claiming that their actions have repeatedly been met with #unconstitutional #arrests & #violence. The protesters last week cited #ReneeGood’s death to push Menendez to expedite her decision.

The judge found that the protesters observed & criticized ICE officers, but “did not forcibly obstruct or impede the agents’ work,” & were otherwise non-violent & non-threatening.

“Peaceful observers & protesters turned out again today, they will turn out again tomorrow, & they will continue turning out every day until Operation Metro Surge is over,” the #activists who sought the restraining order wrote to the judge last week. “These Minnesotans who are peacefully exercising their core constitutional rights to speak & gather continue to be met with #unconstitutional & terrifying #violence … And things appear to be getting worse, not better.”
