Doesn't that actually mean that anyone can be asked about their gender status? I mean if you were sure then you wouldn't need to ask.

Aside from the obvious effect this will have on trans people I can imagine some rather stereotypically masculine looking cis women and stereotypically feminine looking cis men being rather offended when asked what their birth gender is.
