@taatm @a yeah well first thing’s first. Trans rights are more important. In Denmark women can go topless, but unless we’re at the beach, we don’t. As long as breasts are sexualised it’s just extremely uncomfortable.

💯% I entirely agree.
• Trans rights are more important here.
• The cop-out for the right wing is to decriminalise topless women, making an excuse to not arrest these women.
• Breasts are sexualised but so are men’s pecks. My actual issue here is that if a women gets hot and just wants to take her top off, she gets arrested. The woman has no choice and it should be hers.
• I’ve felt disgust at seeing certain men strip off when hot at football matches. I won’t yuk your yum but if there is an indecent exposure thing here that is where I felt it. He won’t be arrested. This feeling would also apply to certain women who would be arrested.
• I prescribe no moral, just demand fairness. Either it applies to all or none.
• I am a straight male. This is just for full disclosure. I can’t speak to any other experience.
• Generally speaking, I like boobs, this comment is just to emphasise how totally stupid the idea is to call it indecent exposure.

Again however, the main issue here is that if a woman tells you she’s a women then she is a women. It’s that simple.

@a It's been tried before, and the trans woman in question was arrested, sentenced for indecent exposure, and sent to men's prison to be set up for rape by the other prisoners.

Fascists don't actually care about consistency if they can just be cruel and inconsistent instead.

It can still be useful for radicalizing some libs, but there are very very real risks involved.

@a The fact that women in general are punished with "indecent exposure" for going topless is part of the whole problem. If men are allowed to be topless in appropriate situations, so should women. If lads can't control their lad, that's not a woman's fault, whether she is cis or trans!

I can think of several grounds in Scots law that they could be arrested & prosecuted, but I'm reluctant to specify them because I won't help transphobes. It would however highlight the ridiculousness of the current spin put on the recent UK Supreme Court decision if COPFS did.

@a would not reach the threshold for indecent exposure which requires display of genitals in a sexual or threatening context. Law in Scotland is different in many aspects but pretty similar to the rest of uk for indecency.

@a I don't know what the law is in Scotland but for it to be indecent exposure I thought you had to deliberately expose an erect male member. Hence streakers tended to be arrested for behaviour likely to cause a breach of the peace. If showing swollen mammary glands is likely to upset the public there's many a builder who is at risk every hot day!
The law on this is an ass; the UK supreme court virtually said as much in my opinion, since the law applied to birth sex, & trans gender is protected.

@a this is of course the point at which we get into the nuance of criminal law, who deals with it and the ongoing implications...

Can the CPS bring charges against them at magistrate's, which is a lower court and whose decisions do not create precedent? Probably.

Would we support anyone so charged to take the case to higher courts and create a meaningful decision? @goodlawproject

Would CPS drop such a case to avoid consequential implications?

Again, let me say, as a cis-ish woman, this is so gross. Inviting the critique and evaluation of women's bodies to find fault with them and determine their worthiness as women is horribly regressive.

I'd say "no woman wants this", but it's not true, because there are women out there demanding we put women's bodies through this type of scrutiny before they are allowed to participate in society.

Want to participate in sports? Let someone look at your genitalia first. Want to go to a public restroom? Have your birth certificate and ID on hand to prove you have the right to pee.

They want to take us back to an age where women couldn't do anything without permission. All for transphobia.

@artemis @a there's also the theory that the transphobia is the excuse for the subjugation, policing and dehumanization of women. I find that a lot more believable than this many people genuinely caring this much about trans people. It also explains them continuing to ignore the existence of trans men.
