Trump’s Sentencing in Hush Money Trial Is Delayed Until After Election Day

The decision by Justice Juan M. Merchan means voters will be left in the dark about whether the former president will face time behind bars.

The New York Times

The judge overseeing Donald J. Trump’s #criminal case in Manhattan postponed his sentencing until after #Election Day, a significant victory for #Trump as he seeks to overturn his #conviction & win back the White House.

In a ruling on Fri, the judge, Juan M. #Merchan, cited the “unique time frame this matter currently finds itself in” & rescheduled the sentencing for Nov 26.

#Merchan had previously planned to hand down Trump’s punishment on Sept 18, just 7 wks before #Election Day, when #Trump will face off against MVP #KamalaHarris for the presidency.
“This is not a decision this court makes lightly but it is the decision which in this court’s view, best advances the interests of #justice,” Justice Merchan wrote in the 4pg decision, which noted that “this matter is one that stands alone, in a unique place in this nation’s history.”

While the decision will avert a courtroom spectacle in the campaign’s final stretch, the #delay itself could still affect the #election, keeping #voters in the dark about whether #Trump will eventually spend time behind bars.
It is unclear whether sentencing Trump in Sept would have helped or harmed him politically;his punishment could have been an embarrassing reminder of his #criminal record, but could have also propelled his [#BS] claims [#lies] of political martyrdom.

Justice #Merchan’s decision came at the request of #Trump, who had asked to #delay the sentencing until after the #election, partly so he had more time to challenge his #conviction. Prosecutors working for the Manhattan DA, #AlvinBragg, who brought the case, had deferred to the judge, paving the way for at least a brief postponement.

The judge’s decision to push the proceeding is likely to infuriate Bragg’s liberal supporters & fuel accusations that #Trump is above the #law, shielded from the consequences of conviction, unlike any other #felon. To avoid that impression, left-leaning legal scholars — & Trump critics seeking catharsis — wanted Justice #Merchan to hold Trump accountable promptly after he was convicted in May of having #FalsifiedBusinessRecords to cover up a sex scandal.

Justice #Merchan, a veteran judge who once vowed to apply “the rules of #law evenhandedly,” was an unlikely deliverer of relief for the former president. Yet his ruling on Friday marked just #Trump’s latest success in dragging out his varied #legal entanglements, a strategy that has paid off in all four #criminal cases looming over the [#abuser]….

The delay will spare #Trump a distraction — & humiliation — at a critical moment. MVP #KamalaHarris’s entry into the presidential race in July upended the campaign & erased his lead in the polls.

@Nonilex
I feel serenely confident that he has plenty of humiliation queued up and ready to fall on him in the very near future.

@Nonilex

Also to be considered (politics isn't in a vacuum)...

Hunter Biden's first sentencing is also a few weeks after the election. It is also a white collar crime. If he gets a prison sentence, it'll be an easier pill to swallow to also sentence Trump to prison.

@chiclet @Nonilex literally nobody cares about the Hunter Biden case except people already voting for Trump.

It’ll do nothing for the general public.

@owlchemist @Nonilex

Yeah, but those people will either be very upset about a Trump sentence and willing to join a violent mob/coup,... or be more apathetic to a "call to arms" if it's pretty obvious that "the Libs" are getting their comeuppance too.

The MAGA right are recruiting disaffected people who think the justice system is unfairly targeting Trump. The Hunter convictions take ammo out of their words, and neutralizes their recruitment talking points.

It's been a noticeable decline in how Trump's persecution complex is landing among independents, since Hunter's conviction. The sentencing will do more.

@chiclet @Nonilex the sad truth is that the Trump supporters don’t need sentencing to do the thing they already did. They’ll do it no matter why Trump loses.

Giving special treatment to a prolific criminal so they won’t do what they’re already planning is a bad decision, imo. Maybe there’s a better reason this is happening, but catering to the worst of the deplorables is not a winning stance.

@owlchemist @Nonilex

It's a game of numbers. And its chess, not checkers.

Trump supporters are out-numbered, but they are recruiting. The Big Lie drove thousands more people to join an insurrection. Disinformation can be disrupted by truth, but what works even better, is denying them the narrative they want.

It is not catering to delay a few more weeks. And it's pretty smart to completely deny them the ammunition.

Just like denying Trump the ability to campaign against Biden, by taking him off the board. Taking sentencing off the board is really hurting Trump's campaign too.

Do you thing Trump doesn't already have slogans lined up and orders for t-shirts ready to go?

@chiclet @Nonilex I was speaking specifically to the idea that the delay may have been to curb violence of his mob.

Trump wants this delay and asked for it. My guess is getting sentenced before the election would have been the worst case scenario for him. There may be some slight benefit to honoring his request, but it’s likely very little compared to the shitstorm of being sentenced. He didn’t need sentencing to incite his mob previously, and he doesn’t need it now.

@owlchemist @Nonilex

Yes, I think the level of violence is not binary, but a variable that has many factors. In the study of domestic extremism in America, the numbers are important. The chatter on the far-right surges when people think he is persecuted unfairly. I do think that the delay could potentially curb mob violence.

I agree Trump's lawyers want the delay, but because it helps with their immunity appeal timeline. I think Trump is often not on the same page as his legal team, and the campaign is actually wanting to use it as a bump (as they did for the trial and verdict).

Trump is a clown who juggles multiple big lie narratives to incite his mob. He's still gonna get his post election "stop the steal" mob going.

But this at least mitigates the possibility of PRE-election riots that could actually disrupt vote counting in major swing state cities.

@chiclet @Nonilex I’m not so sold that they’d be **more** violent with sentencing. They are always just primed, and all it takes is for Trump to lose and claim he didn’t. Which he will.

Not postponing justice could just as easily inspire the (very few) undecided voters not to vote for him. It could inspire demoralized progressives to vote, seeing the pendulum of justice start to swing back at him.

@owlchemist @Nonilex

A larger mob is more violent. Do you disagree with that statement?

Two riots are more violent than one. Do you disagree with that too?

"It could inspire demoralized progressives to vote, seeing the pendulum of justice start to swing back at him."
I definitely am not sold on that. Many more progressives are hung up on other things like Gaza, and are looking for any excuse to conscientiously sit this election out.

If they don't have a bigger reason (justice is only in our hands), then they could very well hand the election to Trump.

@Nonilex it’ll make him really stressed though and event more desperate to win knowing that if he loses then before he even has time to organise the Jan 6 2025 rebellion he’ll be in prison. We’ll just have to hope that tips him,over an edge so dramatic that people actually notice

@Nonilex

I can't help thinking that this is a good decision.
Regardless of the sentence content, the media would have become wall-to-wall Trump.
Civil unrest events were possible, even likely - I know I have been concerned about that.
Harris would have been constantly pulled off message, to talk about Trump.

Better to move it to post election to the hopefully losing candidate.
No point in helping him to a win.

@Nonilex Dragging out. Every time Trump gets a delay, he should be inundated with "Trump in drag" images. He'll hate that.

1,000 drag queens will 'welcome' Trump to London when he visits - LGBTQ Nation

It's still not clear if Trump will be received by Queen Elizabeth during his "working trip," but he'll definitely meet some other queens.

@Nonilex Who says you can't BUY justice in this Country???
