OpenAI illegally barred staff from airing safety risks, whistleblowers say

OpenAI whistleblowers filed a complaint with the SEC where they allege the AI company is silencing employees from sharing concerns about its AI technology.

The Washington Post
"Oops yes it was technically in the terms for some reason but we never meant to enforce it!"
Don Draper said it best
@crumbler you cannot be forced to sign away your rights. That clause is null and void.
@crumbler this just sounds like they know they're committing securities fraud or something, like a big red sign that says "Hey SEC come investigate us"
@thisismissem @crumbler pretty sure they’re also committing federal employment law violations. They’re surely violating terms of getting federal grant money.
Was EvilCorp taken?
@crumbler Surely that's not legal, right?
@crumbler They probably had an AI writing that contract.
@proedie @crumbler That's ok, SCOTUS will have an AI review it.
The bigger question is, OpenAI employs lawyers who think these terms are enforceable?

@crumbler not legally enforceable of course. I believe even in the US those rights are protected and any clause trying to restrict them is null and void.

Of course even empty threats can work as threats.

Whilst they can't legally stop "whistleblowers" they can increase the anxiety about it to discourage it. Classic corporate tactic.

Personally I'd always recommend hiring someone who would be a whistleblower. You won't find more passionate or determined employees!

@crumbler HR using an Early GPT prompt: write and iron clad employee agreement.
@crumbler At first I thought you were saying the AI itself was making staff do this.
@crumbler I'm so fed up with the move fast and break things (possibly illegally) tech bro mindset.
Get ready for a “I’m actually super embarrassed by this” tweet from our lord Sam Altman Monday morning at 9 sharp.
@crumbler @Gargron I can't imagine this is legal, and if it is, need new law to make it illegal. The idea that companies can demand you waive federal rights is absurd.
@crumbler Haha! Why not have them sign away their right to vote and a fair trial while writing this nonsense?
@crumbler assurance that there will be illegal activity from which these companies will need silence from their employees
