The Supreme Court ruled 6-3 that the Bureau of Alcohol, Tobacco and Firearms exceeded its authority when it issued the rule outlawing bump stocks.

In its ruling, the #SCOTUS majority said #BumpStocks do not qualify as #MachineGuns under a 1986 law that barred civilians from owning the weapons. #BumpStocks are a piece of molded plastic or metal that replaces the butt of a #rifle & the handle closest to the trigger. The piece allows a portion of the #gun to slide freely back-&-forth. The recoil from a shot causes the gun to “bump” between the shooter’s shoulder & trigger finger, causing shots to be fired in quick succession.

Rifles equipped w/ bump stocks can fire an estimated 400 to 800 bullets per minute, a rate approaching that of #AutomaticWeapons.

@Nonilex Then we need a statutory limit on weapons or modifications that enable more than X casualties per minute. Make it absolutely explicit and leave zero room for a loophole or a "technically it's not a machine gun..."

I don't care. If you somehow modify a knife to enable it to kill 30 people in under a minute, I think that should also be covered.

@Nonilex “Approaching the rate”? The rate doesn’t define ‘automatic.’ Seems to me if the user doesn’t have to willfully move a finger, it clearly crossed into the realm of ‘automation’ in the plainest reading.

There’s zero controversy about restrictions on modifying receivers on semi-automatics so I really think turning a blind-eye on bumpstocks with same net effect is fucking ludicrous.

@Nonilex SCOTUS appears to have focused on the "single" part of the "pull trigger" language of the statute. They seem to read the statutory language as defining any firearm that requires a trigger pull for each shot - whether that pull is the result of a voluntary choice of a human mind or the result of a purely mechanical response to recoil shock via human bones/muscles - is not a "machine gun".

That's crazy. Bump stocks turn a single initiating voluntary trigger pull into a sequence of subsequent involuntary trigger pulls - the human becomes part of the "machine" part of that "machine gun". The only human volition in that machine system of repetition is that the human can break the cycling feedback loop by relaxing the trigger finger - just like a soldier can end a sequence of more traditional machine gun fire.

Correct me if I'm wrong but the ruling says the ATF had no right to regulate under existing law. It doesn't say that bump stocks are guns are people have a right to them - correct? In that we can still ban them with a new explicit law?

@Nonilex not quite. the triggering mechanism is repeatedly engaged. a straightforward legislative response to this would be to redefine “machine gun” to be any combination of equipment, engineering, automation or skills that enable a weapon to fire more than 150 (or so) projectiles per minute.

@Nonilex Better to say "w/a single voluntary trigger pull".

SCOTUS said "there are multiple trigger pulls, one for each shot fired", which is technically accurate.

However, only the first pull was voluntary. The subsequent pulls occurred without conscious volition as the shooter's muscles, bones, tendons, and other body parts became part of the gun-machine.

Any decent legislative intent review would have led SCOTUS to a conclusion opposite of the one they chose to reach.
