The older practice was to decide whether the specific acts charged violated the law, and "not reach" the question whether other, similar acts might also violate the law.
MylesRydenUnfortunately this Court is even worse than that. I am virtually certain that given exactly the same circumstances with a Democrat President, they will rule the exact opposite way.
I am certain the same thing is coming with abortion. When the GOP did not control the Federal government, it was suddenly a state issue. I am pretty sure that if there is ever GOP control of the House, Senate and Presidency, it will suddenly become a Federal issue again.
That is not activism that is corruption, pure and simple.
Stationkeeper@MylesRyden @petersuber This is as vicious as it is because Republicans have seen they will never be voted in again given a fair election. If sanity does retake the house and the senate I hope Democrats remember this ruthlessness and behave accordingly. Expand the court, create a non-profit/non partisan Office of Elections that's fire-walled from politics, eliminate the electoral college.
