Unsurprisingly, the US prosecutors have opposed Alex Mashinsky's motion to dismiss two of his criminal charges.

The government says his motion to dismiss misunderstands count 2, arguing against something they aren't even claiming. They also go into more detail about how this charge is not contradictory with the commodities fraud charge.
On charge six, they cite the portion of the Commodities Exchange Act that prohibits market manipulation, and argue that any claims that Mashinsky lacked fair notice are premature and must await conclusion of the trial.
