Pregnancy is stressful. Can anyone who has gone through a pregnancy or helped someone go through a pregnancy, even if relatively uncomplicated, imagine how much stress a fatal diagnosis and then government interference with your medical care would add to that?

Texas attorney general threatens doctors with prosecution after court rules woman can get emergency abortion | CBC News

Texas Attorney General Ken Paxton on Thursday threatened to prosecute any doctors involved in providing an emergency abortion to a woman, hours after she won a court order allowing her to obtain one for medical necessity.

CBC

An update on this story: one would think the crafter and elected enforcers of this legislation would have buried their heads in the sand when this bad press press came to light. One would be wrong. Instead the state Attorney General who narrowly avoided impeachment but who remains under criminal investigation, went on the offensive to make sure this women could not get an abortion in the state. The higher court listened and issued a stay on the lower court's ruling. Additionally, the AG said he would prosecute any doctor performing the abortion even if the lower court order had stood. This use of state power to invoke fear of providing adequate medical care will undoubtedly have a chilling effect throughout the US states where similar legislation has been written. The higher court has not provided a time-line for their hearing, even, as we all know, timing is of the essence.

To my knowledge, not even Kafka came up with a story so Kafka-esque.

Court grants Texas woman's request for emergency abortion in historic ruling

Kate Cox asked a Texas court for an abortion to preserve her fertility.

I would like to know from #LegalMastodon if there is any chance that this could go to cruel and unusual punishment. A government body openly forcing sterilization against a doctor's orders would seem to fit the bill.

@Brad_Rosenheim

It's not a criminal sentence in a criminal case. So it's just run of the mill unusual cruelty.

@rjblaskiewicz Interesting. Basically, she'd have to break the law (i.e. get the abortion against court orders) to take it there? Makes sense legally, but, of course, not morally.
@Brad_Rosenheim Mary Ziegler has a very good (but scary) op-ed in The Boston Globe this morning. Iโ€™d share it if I could but I havenโ€™t figured out how to get past the firewall.

You won't see the lovely picture of Ken Paxton, but the text is all there.

Texas abortion: Kate Cox case reveals broader antiabortion strategy

A court allowed an abortion to proceed โ€” and then the state warned doctors not to perform it. Is that possibly constitutional?

The Boston Globe
@Brad_Rosenheim Fortunately she fled to a civilized state where women still have rights to lifesaving healthcare. Iโ€™m sure the next TX move will be to try to prosecute her for that. This is all so horrifying.
@skry Yes, I'm expecting that shoe to drop too. And, whereas it is fortunate for her, the TX Superior Court ruled against her last night, setting an awful precedent. The next person with a similar pregnancy will not even get as far as she did. Will they be able to leave the state?
@Brad_Rosenheim I have gone through a traumatic pregnancy and yes, yes, I can imagine! "Our bodies, our choice" has never been clearer to me. I want full autonomy over my body, esp. over my pregnant body.
@Brad_Rosenheim
Paxton, like Trump, is a rabid dog and needs to be put down. When will the voters in Texas wake up.
Remember when it used to be a Blue state. What happened?
