β€” In my view the court should have given the government a reasonable period of time to enact a law, and if they fail to do so, schedule a hearing to revisit the issue if the #government #refuses to take #action to #protect the #inalienable #HumanRights of the #LGBTQ #Community in India citing Article 16 of the Universal Declaration of Human Rights.

#UniversalDeclarationofHumanRights #Article16

Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.

Marriage shall be entered into only with the free and full consent of the intending spouses.

The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

The UDHR was adopted by the United Nations General Assembly on December 10, 1948, and India was one of the 48 countries that voted in favor of the adoption.

The Declaration serves as a common standard of achievements for all peoples and all nations and sets out fundamental human rights that should be universally protected.

India also ratified the International Covenant on Civil and Political Rights (ICCPR) - which enacts the UNDHR Article 16. Article 23 specifically deals with the right to marriage and family life. India is a party to this treaty, having ratified it in 1979.
