Peter Hense 🇺🇦1/x Big Tech doesn't enter into cease-and-desist agreements in Germany? Well, that's not entirely true. #Google Ireland Ltd. has signed a declaration to #CeaseAndDesist in the proceedings regarding the design of its own "cookie banners".
2/x By signing the agreement, they prematurely ended the proceedings before the Berlin Regional Court (Ref.: 52 O 79/22). Google has agreed to refrain from using (unfortunately only some) misleading designs in cookie banners (so-called #DeceptiveDesigns or "#DarkPatterns").
3/x With Google's revised cookie banners, "#cookies" (short for tracking technologies and subsequent processing activities) can be rejected as easily as accepted, which is what the law intended. #GDPR #ePrivacy #UCPDirective #UnfairContractTermsDirective
