@chris I believe he has been misrepresented by Western right wing christians. As a saint, Nic will be inclusive and non judgemental. Gift all children regardless of circumstances #xmas #santa
@princelysum @chris
Nah. We are, after all, talking about the bloke who allegedly assaulted Arius in the middle of the Council of Nicea.
@chris
So this means Elon Musk has suspended #Santa from #theBirdSite ?
@takvera @chris No, didn’t ban Santa (Elmo doesn’t care about Data Protection Regulation either) but the NORAD SantaTracker (DONT DOXXX DUDES’ PLANES)
@chris GDPR Article 4 is just a list of definitions. You can't be in violation of the 'definitions'. I think you mean Article 7 (consent), Article 8 (children's consent), Art 15 (right of access by the subject), Section 3 (rectification and erasure), and Section 4 (right to object).

@chris His defences are "Processing is necessary to satisfy a contract to which the data subject is a party." and "Processing is necessary to perform a task in the public interest or to carry out some official function."

#SantaGDPR

@chris Santa is in contravention with the definitions of the GDPR? Article 5 would make more sense 🧐
@chris He should be OK as long as he only uses the data for the purpose for which it was collected, surely? @lilianedwards would know...

@chris

Might get away with 'legitimate interest'.

Bigger question: is that 'Data concerning health'?

@chris I think this originated on Twitter with @mutablejoe (although I could be wrong, apologies if so)

@chris article 4 is just the definitions… I think it should be article 6

Oh boy do I feel smart! 😁

😏

@chris
He sees you when you're sleeping
He knows when you're awake
He knows if you've been bad or good
So be good for goodness sake!

You better watch out

@chris
I would argue that Santa has legal basis for the data processing?😉

Exercise of official authority or task in the public interest:
The data controller must process personal data in order to carry out its duties as an authority or to carry out a task in the public interest.

@chris He can claim he's a journalist though
@chris What if Santa actually is GDPR compliant, and kids who don't send a letter to the north pole allowing him to collect their data simply don't get any presents.
@chris Making a FOIA request to the ICO to find out how many complaints have been lodged against Santa
@chris the fact that he has to check it twice is an information security problem of integrity...
@chris Brb, gonna send GDPR request to know if I'm on the naughty list or not. He has 30 days to respond tho, so probably won't get a response before xmas..
@chris (source: cafreiman, birdsite)
@chris yeah Santa accepts our cookies, but we never accepted his 🤔
@chris Santa Claus has received a data request, as defined in the GDPR

@chris

It could be argued that by checking his list twice, he's doing his due diligence and pruning those that haven't given consent.

Of course, he's also well known for not sharing data with third party delivery companies too, choosing instead to handle the fulfillment side himself.

I would also think that he's been given explicit right to use the data, for a specific purpose. I can't remember the last person that wrote to him asking for advice on Crypto.

@chris

Actually, Santa's elves are compiling the data from public sources including police reports, local newspapers, social media and self-reporting.

@chris @MostlyUnpainted

Now who didn’t try to sing that?!

@chris The real challenge would be successfully executing any judgement against Santa. His bases strategically advantageous location at the north pole rules out any sort of ground assault, while the air combat capabilities of his reindeer exceed the combined power of every air force on earth.

We are at the mercy of a jolly red god, it is best not to get on his naughty list.

@chris Santa might have a so called "legitimate interrest" for processing the data on his list. In this case he may use the data as long as it is needed to fulfill the process. Afterwards he has to delete the list :D
@chris never thought there would be a category of GDPR jokes
@chris @bartekpi there is an exemption for churches/religious association, so at least in countries where he's got their affiliation he isn't in breach.
@chris @teehuntz please get your form in
@TradingPlacesResearch @chris really debating whether 4% of my worldwide global revenue is worth the effort here.
