The judge asked the Prosecutor if there was any evidence of violence by Azad.
"Do you think our Delhi police is so backward that they have no recorded evidence? In small matters Delhi police have recorded evidence why not in this incident?", she asked.

When the Prosecutor replied that permission had to be taken for protests, the Judge said :
"What permission? SC has said repeated use of 144 is abuse (referring to recent Kashmir case decision)".

The Judge also added that she had seen many people who had protested outside Parliament going on to become leaders and Ministers later on. The judge also commented that Azad was a "budding politician" who had the right to protest.

Chandra Shekhar Azad Granted Bail On Condition To Stay Out Of Delhi For A Month

Additional Sessions Judge Dr. Kamini Lau of Tis Hazari courts imposed the condition that Azad should stay out of Delhi for a month and should remain in his native place Saharanpur in Uttar Pradesh during the said period.

"These are special circumstances. I do not want any trouble during Delhi elections", Judge Lau remarked.
"If he has dharnas planned, he should not carry them out for a month", added the Judge.

The Court said that the bail conditions will remain in force for a month. He can also seek modification of the conditions, when any other verified address is given. The Court insisted on his stay at Sahranpur on the ground that he had given that address to police.
Azad has to mark his presence with SHO in Saharanpur every Saturday for the next 4 weeks. He has also been asked to furnish a bail bond of Rs.25,000.

ASJ Dr Kamini Lau of Tis Hazari courts allowed Azad's application for modification after noting that the prosecution could not show any material that his presence in the national capital would cause violence. The plea, filed by advocates Mehmood Pracha and O P Bharti, said Azad was not a criminal and claimed imposing such conditions were wrong and undemocratic.

The modified conditions are as follows:
● The condition regarding marking attendance at Saharanpur SHO on every Sat. modified to state that it can be marked before Daryaganj DCP, if he is in Delhi on Sat.
● He has to inform DCP telephonically or by email if he is somewhere else other than Delhi or Saharanpur.
● Whenever in Delhi, he should inform his schedule to DCP Crime.
● Whenever in Delhi, he should reside at the address given.
