Judge orders new trial for woman sentenced to 18 years in prison after stillbirth
A judge vacated the conviction of an Alabama woman sentenced to 18 years in prison after a stillbirth. Brooke Shoemaker was convicted of criminal endangerment of a child resulting in death after admitting to using methamphetamine during her pregnancy. Her attorneys said there was no evidence the drug use caused the pregnancy loss. They submitted an expert’s opinion that the pregnancy loss was caused by genetic abnormality and severe infection. Circuit Judge Jeffrey Tickal ruled last week that Shoemaker should receive a new trial. Prosecutors are appealing the decision.
