Ummmm….. I see nothing here that would deter large corporate entities from reckless neglect. Your model assumes harm to individuals is inevitable, and a big payout will make it all okay.

Imma stick with regulation that would make sure a mile-long train lugging toxic chemicals is not running on antiquated brakes, and that guarantees communities know the manifest of all cargo passing through.
