Counts 14, 15 and 27 of the indictment to engage in “an overt act in furtherance of the conspiracy” would “interfere with the District Court’s ability” to apply justice to potentially falsified documents by “imposing a state sanction when a federal sanction is already in place.”

The judge overseeing the Georgia election interference against Donald Trump and others has tossed out three counts in the indictment saying that they lie beyond the state’s jurisdiction. That includes two counts brought against the former president. At issue are two counts having to do with the filing of a document with the federal court in Atlanta that declared that Trump had won the state of Georgia and 16 Republicans who signed the document were the “duly elected and qualified electors” from the state. The third count charges Trump and lawyer John Eastman with filing false documents, saying they “knowingly and unlawfully” filed a a lawsuit with the federal court in Atlanta that included false statements about the 2020 election in Georgia.

A conservative attorney who pushed a plan to keep Donald Trump in power has turned himself in to authorities on charges in the Georgia case alleging an illegal plot to overturn the then-president’s 2020 election loss. John Eastman was booked at the Fulton County jail Tuesday. Eastman is charged alongside Trump and 17 others, who are accused by Fulton County District Attorney Fani Willis with scheming to subvert the will of Georgia voters in a desperate bid to keep the Republican president in the White House after he lost to Democrat Joe Biden. Eastman says the indictment "should never have been brought.”
