Company execs joked about their customers, privately saying they were "robbing them blind, baby." Today, a jury handed the ticketing and concert giant a complete defeat.

Eso es exactamente lo que convierte a Ticketmaster en algo mucho peor que una empresa dominante. La demanda de 2024 describe una maquinaria de exclusividades de largo plazo, amenazas y represalias contra recintos que intentaban trabajar con rivales, adquisiciones destinadas a neutralizar amenazas, y un proceso perfectamente diseñado para reforzar un poder que se alimenta a sí mismo. El veredicto de abril de 2026 va aún más lejos en su nivel de concreción: el jurado concluyó que Ticketmaster mantuvo ilegalmente un monopolio en los servicios de venta de entradas para grandes recintos, que Live Nation monopolizó el mercado de grandes anfiteatros, y que además obligó de forma ilícita a artistas que querían actuar en esos anfiteatros a utilizar también sus servicios de promoción. Traducido al castellano llano: o juegas con ellos, o no juegas. Una auténtica mafia."

La giuria di New York, mercoledì 15 aprile, ha stabilito che “il gigante dei concerti Live Nation e la sua controllata Ticketmaster detenevano un monopolio anti-concorrenziale sui grandi luoghi per concerti”. La giuria si è basata sulle accuse di decine di stati degli Stati Uniti, secondo cui il colosso della biglietteria per l’intrattenimento avevano una posizione talmente dominante da danneggiare gli spettatori di concerti e gli appassionati di sport. Live Nation Entertainment possiede, gestisce o controlla le prenotazioni per centinaia di luoghi. La sua controllata Ticketmaster è ampiamente considerata il più grande venditore di biglietti al mondo per eventi dal vivo.
La causa civile, inizialmente guidata dal governo federale degli Stati Uniti, accusava Live Nation di “aver usato la sua influenza per soffocare la concorrenza”. Live Nation ha dichiarato in un comunicato che non solo nega il monopolio, ma che “il verdetto non è l’ultima parola sulla questione e ha promesso ricorsi”. Un avvocato degli Stati l’ha definito “un grande giorno per il diritto antitrust”.
Ma cosa accadrà nel concreto? La sentenza potrebbe costare a Live Nation, si parla di centinaia di milioni di dollari e forse la società potrebbe essere costretta a vendere alcune delle aree da concerto, quando il giudice emetterà le sanzioni. Tra le altre cose, la giuria ha scoperto che le pratiche anticoncorrenziali di Ticketmaster “hanno portato le persone in 22 Stati a pagare 1,72 dollari in più per biglietto“, che il giudice potrebbe ordinare alle società di restituire.

“Ticketmaster and Live Nation held an anti-competitive monopoly for concerts”: that was the verdict of the New York jury. The live agency replies: “We will appeal.”

Historic verdict in the context of large live concerts and antitrust. The New York jury, on Wednesday, April 15th, ruled that “Live Nation, the giant of live concerts, and its subsidiary Ticketmaster held an anti-competitive monopoly on large concert venues.” The jury based its decision on the accusations of dozens of US states, according to which the entertainment ticketing giant had such dominance that it harmed concertgoers and sports fans. Live Nation Entertainment owns, manages, or controls reservations for hundreds of venues. Its subsidiary Ticketmaster is widely considered the world’s largest seller of tickets for live events.

The civil lawsuit, initially led by the US federal government, accused Live Nation of “using its influence to stifle competition.” Live Nation stated in a statement that it not only denies the monopoly but that “the verdict is not the final word on the issue and has promised appeals.” An attorney for the States called it “a great day for antitrust law.”

But what will happen in practice? The ruling could cost Live Nation, reportedly hundreds of millions of dollars and the company could be forced to sell some of its concert venues, when the judge issues the sanctions. Among other things, the jury found that Ticketmaster’s anti-competitive practices “caused people in 22 states to pay $1.72 more per ticket,” which the judge could order the companies to refund.
