Il Tempo: Avvocato Fiore: "Censurati manifesti inoffensivi"
Roma, 2 mar. (Adnkronos) - “Le amministrazioni pubbliche e i giudici hanno censurato spesso i manifesti inoffensivi di Pro Vita & Famiglia Onlus, applicando le stesse norme che si dovrebbero applicare solo alla pubblicità commerciale. Le comunicazioni sociali e politiche, però, non dovrebbero sottostare agli stessi criteri, in quanto la libertà per parlare di temi di rilevanza pubblica, come la vita nascente, il fine vita e la libertà educativa, dovrebbe essere molto ampia”. A dirlo Alessandro Fiore, legale di Pro Vita & Famiglia, all'incontro con la stampa organizzato da Pro Vita & Famiglia Onlus a Roma per denunciare il fenomeno della censura preventiva su messaggi a difesa della vita, della famiglia e della libertà di espressione, dal titolo ‘...E Io parlo!'.
“Inoltre, la libertà di espressione è un diritto tutelato sia dall'articolo 21 della Costituzione, sia dall'articolo 10 della Convenzione europea dei diritti umani - spiega - Purtroppo, i giudici amministrativi in Italia, fino al Consiglio di Stato, ci hanno riferito che non si possono affiggere messaggi che possono turbare o offendere la sensibilità di qualcuno”.
“La nostra risposta è stata fare ricorso alla Corte europea dei diritti dell'uomo, perché nella giurisprudenza della Corte di Strasburgo è chiaro che la libertà di espressione deve essere tutelata anche in relazione a messaggi che potrebbero offendere o turbare qualcuno, soprattutto, ad esempio, in tema di aborto. Questo tema, infatti, è riconosciuto dalla Corte di Strasburgo di interesse pubblico, quindi i limiti a riguardo dovrebbero essere molto ampi”, conclude.
Lawyer Fiore: "Offensive posters censored"
Rome, March 2 (Adnkronos) - “Public administrations and judges have often censored the harmless posters of Pro Vita & Famiglia Onlus, applying the same rules that should only apply to commercial advertising. However, social and political communications should not be subject to the same criteria, as the freedom to speak about relevant public issues, such as nascent life, end-of-life issues, and educational freedom, should be very broad.” This was stated by Alessandro Fiore, legal counsel for Pro Vita & Famiglia, at an event with the press organized by Pro Vita & Famiglia Onlus in Rome to denounce the phenomenon of preventative censorship of messages in defense of life, family, and freedom of expression, titled ‘...And I Speak!’.
“Furthermore, freedom of expression is a right protected by Article 21 of the Constitution and Article 10 of the European Convention on Human Rights – he explains – Unfortunately, the administrative judges in Italy, up to the Council of State, have told us that we cannot display messages that could disturb or offend someone’s sensibilities.”
“Our response was to appeal to the European Court of Human Rights, because in the jurisprudence of the Strasbourg Court it is clear that freedom of expression must be protected even in relation to messages that could offend or disturb someone, especially in the case of abortion. This issue, in fact, is recognized by the Strasbourg Court as of public interest, therefore the limits regarding it should be very broad,” he concluded.
