La Corte di Cassazione ha annullato l’arresto di Mohammad Hannoun, l’attivista e architetto palestinese accusato di aver finanziato Hamas con la sua Associazione Benefica di Solidarietà con il Popolo Palestinese (Abspp). L’uomo di 64 anni era stato arrestato a fine dicembre insieme ad altre sei persone. Due di loro, Raed El Salahat e Khalil Abu Deiah, erano già stati scarcerati mentre invece erano stati confermati gli arresti di Hannoun, Ra’ed Dawoud, Yaser Elasaly e Ryad Albunstanji. Per tutti e quattro la Corte ha rinviato la decisione a una sezione del Riesame di Genova. In attesa della decisione Hannoun resterà in carcere a Terni.
Il collegio difensivo si è detto soddisfatto per la decisione della Cassazione. “In attesa delle motivazioni della Suprema Corte pare evidente che il tribunale dovrà riconsiderare le posizioni degli indagati per i quali era stato provato solo l’invio a Gaza di aiuti alimentari e di denaro destinato ad attività umanitarie di sostegno alla popolazione civile”. Per i legali “è importante anche che la Cassazione abbia dichiarato inammissibile il ricorso della procura della Repubblica di Genova diretto a fare entrare nel procedimento i documenti trasmessi dai servizi segreti israeliani e già esclusi dal Riesame”.
Hannoun vive a Genova dal 1983. La Procura ha iniziato a sospettare di possibili legami con Hamas già alla fine degli anni Novanta ma le accuse furono archiviate. Le attività dell’Associazione però erano rimaste sempre sotto controllo e tra il 2021 e il 2023 diverse banche e operatori di pagamento avevano bloccato i conti dopo alcune segnalazioni dal governo di Israele. La fondazione era stata accusata già in passato di organizzare raccolte fondi spacciandole per beneficenza a scopi umanitari, ma Hannoun ha sempre negato.

The Court of Cassation has overturned the arrest of Mohammad Hannoun, the Palestinian activist and architect accused of financing Hamas through his Association for Solidarity with the Palestinian People (ASPSPP). The 64-year-old man had been arrested at the end of December along with six other people. Two of them, Raed El Salahat and Khalil Abu Deiah, had already been released while the arrests of Hannoun, Ra’ed Dawoud, Yaser Elasaly and Ryad Albunstanji were confirmed. For all four, the Court has deferred the decision to a section of the Appeals Court in Genoa. Pending the decision, Hannoun will remain in prison in Terni.
The defense team said they were satisfied with the Court of Cassation’s decision. “Pending the motivations of the Supreme Court, it seems evident that the court will have to reconsider the positions of the investigated, for which only the sending of food aid and money intended for humanitarian activities in support of the civilian population was proven.” According to the lawyers, “it is also important that the Court of Cassation has declared inadmissible the appeal by the Public Prosecutor’s Office of Genoa, aimed at involving the documents transmitted by Israeli intelligence services, which had already been excluded by the Appeals Court.”
Hannoun has lived in Genoa since 1983. The Prosecutor began to suspect possible links with Hamas at the end of the 1990s but the accusations were dropped. The Association’s activities had always been under surveillance and between 2021 and 2023, several banks and payment operators had frozen the accounts after some reports from the Israeli government. The foundation had already been accused in the past of organizing fundraising campaigns disguised as charitable activities for humanitarian purposes, but Hannoun has always denied it.
