Every society will need different forms of guidelines. These guidelines help those living within the society. They allow people to know how to get along. Sometimes these will be officially written down, other times they will be unofficial. Those unofficial rules will usually be malleable as the people and situation warrants. When it comes to the official rules, they are strongly debated before they are created then written into some register for people to refer to,
Time It
Different time periods handled their ways of laws and rules differently. In some eras, lords delivered justice whenever they perceived wrongdoing. They had the power to grant the appropriate punishment. Others need a complicated system. It has a separation of those who gather evidence. Others determine guilt. More grant punishment once guilt is determined.
- Feudal Europe: During this period, the town marshal was the law enforcer for the town. Anyone who entered had to announce their presence through his office. Since he is the law, when he claims that someone has dome some crime, then his guilt has already been determined. He also states what the punishment will be. If he calls someone to the stockades, that is where that person goes. If he determines they shall be killed, that will be their punishment.
- Feudal Asia: Asia during this time had a unique form of police and courts. They functioned differently from what is seen today. The police of this period were more accurately the shogunate. Then the accused would be brought before the Lord for determination of guilt and punishment.
- Renaissance: As the medieval ages were ending, people started demanding more fair legal codes. At first, there was a separation for nobility. Law enforcement agents gathered material against them. This material was used in a state court to determine their guilt. In that court, the noble hired representatives to speak on their behalf. The law officer had an agent carry out the same for them. After guilt is determined, then the court would state some appropriate punishment. In time, this method gets carried over to the general populace.
- Modern: The modern system is essentially the same as what evolved out of the Renaissance. In most societies, there will be police that are needed to gather evidence that establishes someone’s guilt. Then this evidence is taken to the courts who evaluates its validity and decides if the suspect is guilty. Once proven guilty, the suspect will be given a punishment that is worthy of the accused crime.
These are the normal conditions that will be found during each period. While most of feudal Europe can be defined the same way, there will be pockets that followed a different rule. While most of Europe gets defined the under the same umbrella, the region that becomes Norway follow different rules. Remember that the Americas existed before the Europeans came over to colonize. On those continents, there were several different tribes each of which handled the law and justice in some unique manner.
Gaimification
While gaming, players are free to create whatever legal system they want. If they are playing a fantasy game, they can still choose to have a modern system. They should be capable of getting it. There is only one hard rule: be consistent. If the setup requires everyone to report to the Marshal’s Office in every city, the PCs should report there. They must comply unless the city lacks such an office. If they do not execute this when possible, repercussions should follow. These repercussions must apply no matter how powerful, wealthy, respected, or anything else they are. Such repercussions warrant for arrest, price on heads, seizure of assets, or anything else that is appropriate. At times, people are obligated to change the legal code that they are using. For example, they are in the traditional supers campaign. Here, the code is using the modern system. However, that system does not allow for people who can literally walk through walls. It doesn’t accommodate those who hold mind powers. It doesn’t support those who travel at supersonic or superluminal speeds. It also doesn’t cover those who fire blasts that are as strong as any traditional firearm.
The legal code has gone through several changes over the ages. It went from something that was local enforced by whoever was doing the investigating. This is anywhere from one lone enforcer who does the investigating and dealing of justice to the separation of each. Usually, such matters will be a background feature. Nevertheless, the PCs can have a powerful impact. They can influence when, where, and how they deal with those enforcers of the law. This can create great story moments. Players will want to retell these stories for many years to come.
