Bahaha- it's ADORABLE that this "originalist" scholar thinks that aaany of the #scotus 'conservatives' give one flying fđ€Źck about a consistent legal philosophy, let alone what the founding fathers thought of a wannabe despot.
Originalists/textualists like scalia and his somehow grosser progeny have ALWAYS used it as a fauxlosophical smoke screen for cherrypicked #fedsoc activism whenever it suited them (see also unitary executivism)
That's why they're #supremeCourtesans

Caleb E. Nelson, a leading originalist law professor, challenged the conventional wisdom of the âunitary executive theoryâ in an article that was debated in the partiesâ briefs ahead of Mondayâs arguments.
A 7-2 #scotus decision against the #environment & for #fossilFuels. One 'liberal' justice signed on because...well, as a whole they still tend to think that they're in some sort of jurisprudential court system that hasn't existedâeven superficiallyâsince before *half* of the population was even born.
"Jackson & Sotomayor dissented. (Kagan signed on to the #supremeCourtesans opinionâPERHAPS IN PART TO BUILD GOODWILL AMONG THE CONSERVATIVES)"
Fđ€Źcking pathetic.

By now everyone must understand that the only part of the Constitution that matters is the 2nd Amendment. Everything else is either ignored or interpreted however the right wing wants it to be interpreted. #SCOTUS #SupremeCourtesans
Let's also change our system so that we, the People, elect Supreme Court judges. We already elect supreme court judges for some state supreme courts, so why not for the federal supreme court? #SCOTUS #SupremeCourtesans
@futurebird
I think a lot of it had to do with the #scotus of it all, too. They've *completely* done away with even the faintest lofty notion that "no one is above the law," especially when it comes to tfg.
And they worded their decision so that hicks' testimony could be ruled inadmissable. So I think Merchan chose to keep the case under his control, instead of letting it get to the purview of the #supremeCourtesans, where they could toss it completely & 'vindicate' trump
Wonder what new shitstorm the #SupremeCourtesans will whip up this week...
