undefined | Delhi court grants bail to 'conman' Sukesh Chandrashekhar; cites right to speedy trial

A Delhi court on Tuesday granted bail to alleged conman Sukesh Chandrashekhar in a money‑laundering case linked to the AIADMK’s “two leaves” election symbol. Special Judge Vishal Gogne ordered his release on a personal bond and a surety bond of Rs 5 lakh each, while noting that Chandrashekhar will remain in custody for other pending cases.

In his verdict, the judge stressed that personal liberty is a fundamental constitutional right that cannot be curtailed disproportionately, even in economic‑offence cases. He observed that the Prevention of Money‑Laundering Act (PMLA) should not be wielded to deny an accused the right to bail, especially when the accused has already secured bail in most of the other cases against him. The court also highlighted that prolonged pre‑trial detention without trial violates the principle of speedy justice.

The judge further pointed out that the predicate offence and the PMLA proceedings have been effectively stayed for years, resulting in Chandrashekhar’s extended incarceration without trial. Consequently, the court concluded that continuing his detention in this particular matter would amount to excessive and unjustified detention, compelling the court to grant bail while the other cases proceed separately.

The decision comes as a number of serious criminal cases in Toronto have collapsed due to delay caused by the lack of judges in Superior Court.

Lawyers for Attorney General Ken Paxton seek dismissal of state securities fraud charges

Paxton’s attorneys argued that nearly nine years of delays – many of them on procedural motions brought by the defense – have denied Paxton his constitutional right to a speedy trial.

The judge said any other defendant who files for a #SpeedyTrial before Oct. 23 will “immediately join” Powell & Chesebro, & that he received assurances that other #Fulton judges “stand ready to begin a second #trial” in the Nov & Dec term of court if necessary.

The judge said for #Chesebro & #Powell, he intends to have a #jury selected & sworn in by Nov 3 to adhere to speedy trial deadlines.

In its filing earlier this week, the DA’s office raised concerns that a 2nd group of defendants could demand speedy trials separately from #Chesebro & #Powell, raising the potential for a 3rd #trial.

#McAfee noted that 9 defendants, including #Trump, have since indicated they were waiving their rights to a #SpeedyTrial in exchange for being severed from Powell & Chesebro.

Superior Court Judge Scott #McAfee ruled that 17 of the defendants would be split off — or #severed, in #legal parlance — from Kenneth #Chesebro & #SidneyPowell, who have demanded speedy trials & are set to be tried on Oct. 23.

In a 7-p order, McAfee said splitting off the 17 defendants who did not want a #SpeedyTrial was “simply a procedural & logistical inevitability.”
