An Ontario judge has denied a municipality’s request to clear a homeless encampment, citing a constitutional right for a person to shelter themselves if accessible indoor spaces aren't available.
The Region of #Waterloo had claimed the roughly 50 people living in a #Kitchener encampment were in violation of its trespassing bylaw.
But the judge found the bylaw violates Charter rights of encampment residents because the region lacks adequate shelter spaces.
