s.33 is used when <i>passing</i> legislation, not when invoking a power described within legislation, as was the case here.

If s.33 were used to pass the Emergencies Act, it would have to be reviewed and re-passed every 5 years, even if it hasn't been used.

The Emergencies Act is a normal piece of legislation that empowers the Executive Branch to declare an emergency that temporarily suspends sections of the Charter of Rights and Freedoms, with certain conditions, exceptions, and post-hoc analysis.
