HRLC summary: https://www.hrlc.org.au/case-summaries/commonwealth-of-australia-v-yunupingu/

'In a landmark ruling, the High Court has set an important precedent that the Commonwealth is liable to pay compensation to First Nations Peoples if their native title rights have been compromised by certain historical government decisions. In this case, this included government decisions to grant mining leases.

The High Court unequivocally affirmed the Gumatj Clan of the Yolgnu people’s right to ‘just compensation’ under native title law for historical acts which adversely affected their native title rights in the Gove Peninsula. The decision recognised the Gumatj Clan’s enduring connection to the Gove Peninsula in North-East Arnhem Land.'

This land has been home to my family for five generations. It has been home to the Wurundjeri Woi-wurrung people for tens of thousands of years.

My ancestors came here as part of a colonial project. Our enjoyment of this land rests on the forcible dispossession of its traditional owners. Sovereignty was never ceded.

Native title for the Wurundjeri Woi-wurrung people? Yes please!

It’s way past time to acknowledge our histories. Let us care for this living land together.

Native title holders from a vast area in the north of South Australia, including Kati Thanda-Lake Eyre, have welcomed a win in the High Court of Australia today over their rights to a parcel of land near Oodnadatta, which was left out of their original claim.

A group of Arabana people travelled to Canberra to see the result, after a long battle for their native title rights for the area to be recognised.

Among them was Aaron Stuart who has been part of a long battle over the land.

"As an Aboriginal person, my mind goes back to those we lost on the journey," Mr Stuart said outside the High Court. https://www.abc.net.au/news/2025-04-09/sa-lake-eyre-high-court-native-title-win/105157490 #auslaw #auspol #IndigenousIP #nativetitle

Trump invokes 18th century law to speed deportations, judge stalls it hours later

A federal judge barred the Trump administration Saturday from carrying out deportations under a sweeping 18th century law that the president invoked just hours earlier to speed removal of Venezuelan gang members from the United States. U.S. District Judge James E. Boasberg said he needed to issue his order immediately because the government already was flying migrants it claimed were newly deportable under Trump’s proclamation to be incarcerated in El Salvador and Honduras. Earlier, Trump claimed the Tren de Aragua gang was invading the United States and invoked the Alien Enemies Act of 1798, a sweeping wartime authority.
