5 of today’s justices personally & significantly #benefited from the consequences of the ruling, including by accepting jobs or appointments under #Bush’s admin [add Neil #Gorsuch to the above list]. Not only have none of these #conservative jurists expressed remorse about their actions or the decision, w/ #MooreVHarper they have in fact normalized the court’s meddling so that if the opportunity arises, they can do so again.

In Aug, #SCOTUS used its #ShadowDocket to allow #Arizona, a key swing state, to require proof of citizenship w/ voter registration forms at the request of the #RNC.

But perhaps least known—& yet, most important—was #MooreVHarper, a 2023 ruling in which the court set the stage for the next #BushVGore scenario by holding that the justices themselves would have THE LAST SAY when it comes to questions over state-level #election rules & disputes.

With its 6-3 ruling in Moore v. Harper, the Supreme Court has ruled that the (fringe? debunked?) Independent State Legislature Theory is dead. Eliza Sweren-Becker, Senior Counsel in the Democracy Program at the Brennan Center for Justice, explains how this decision preserves democracy in the United States--at least for now.

Reporter discovers man named in 303 Creative case is not gay and did not request a wedding website

Michael Steele is joined by Melissa Gira Grant, writer for The New Republic and Neal Katyal, former Acting Solicitor General during the Obama administration who argued and won a major win for voting rights in the landmark Moore v. Harper case this week. Grant discusses her reporting that the man named in Supreme Court’s 303 Creative ruling didn’t actually request a wedding website and other bizarre details that raise questions about the case's legitimacy. “This was built on a fiction. It was based on an injury that has never happened,” Grant explains. Katyal discusses the harmful implications of arguing hypothetical cases. “It’s a tragedy that they didn't find this information before,” Katyal says. “There is a procedure to get this case stricken from the books…Otherwise, the Supreme Court can dragged into all sorts of controversies that aren't legal cases but just imaginary fights between people and that's not what the court is about.”

Supreme Court directs Ohio's top court to take another look at redistricting lawsuit

Ohio's top court has been ordered to take another look at the legality of the state's congressional districts. The U.S. Supreme Court on Friday set aside the Ohio court's previous ruling striking down the districts and told it to consider the case again in light of its recent decision in a North Carolina redistricting case. In that instance, the U.S. Supreme Court shot down an expansive version of the so-called independent state legislature theory, which suggests state legislatures have absolute power on federal election rules. The high court instead said that state courts can continue to have a role in reviewing such cases.

And before anyone says "but look at the outcome in #MooreVHarper" note - the Court decided the Constitution did not immunize legislatures from their courts. A justice who wants to undo court reform legislation would have no problem squaring that circle.

The Supreme Court’s decision in Moore v. Harper on Tuesday is a major reprieve for American democracy. By rejecting the radical idea that state legislatures have quasi-unlimited power to determine how elections are run, the court made it harder for lawmakers to engage in the shenanigans that Donald Trump encouraged to overturn his 2020 presidential reelection loss. #Jan6coup #TrumpCrimes #MooreVHarper
