Double win! After we caught Radius Recycling releasing polluted runoff around the Bay Area, the company agreed to make up for its past pollution by paying $400k for the conservation & care of the Bay's most imperiled fish species, including Chinook Salmon, Green Sturgeon, and Longfin Smelt 🐟

Call Senators Schiff & Padilla to Reject Attack on Endangered Species Act - San Francisco Baykeeper

After a 17-year-long battle, Baykeeper’s legal team finally won a court order that compelled the federal government to protect the Bay's Longfin Smelt by listing it as an endangered species. But last week, the House of Representatives, voted to undo the listing. Now, the fate of this important species rests with the Senate. The best

Congress is expected to vote on a Republican resolution to reverse endangered species protections for the Bay's Longfin Smelt--and it could set a dangerous precedent.

“Generally we’re seeing an all-out assault on the #EndangeredSpeciesAct and protections like it,” said Cameron Walkup at @Earthjustice which opposes the resolution along with Baykeeper and several other of our partners. Walkup called the Congressional Review Act “an undemocratic, scorched-earth policy (that) makes it so a bare majority in Congress can overturn any law.” https://www.sfchronicle.com/climate/article/longfin-smelt-endangered-sf-bay-20301394.php

The Feds have a new proposal for Longfin Smelt habitat, but the plan doesn't go far enough, as our science director @jarosenfield explains: "Critical habitat is supposed to include habitats where the fish doesn't live but that the fish depends upon... Smelt require abundant flow of fresh water from the Central Valley rivers through the Delta to San Francisco Bay. That's the one thing they respond to." https://www.eenews.net/articles/feds-propose-critical-habitat-for-another-california-smelt/

Feds propose critical habitat for another California smelt

At issue is the longfin smelt, whose better-known relative, the delta smelt, has long been at the heart of high-profile habitat battles.

Our science director @jarosenfield first petitioned to have the Bay’s imperiled longfin smelt protected in 1992. Now, years later, this tiny silver fish is finally getting federal protection in #SanFranciscoBay:

“I’m glad that the federal government has finally done what it’s responsible for doing, which is acknowledging that longfin smelt are endangered and working to protect them based on the best available science,” Rosenfield told the Chronicle:

For years, we and our allies have been fighting to get the Bay's #longfinsmelt the protections they need to survive--while populations have plummeted by over 99%.

And now, the hard work paid off! As of this month, longfin smelt are protected under the Endangered Species Act 🐟

We've officially put the US Fish & Wildlife Service on notice of our intent to sue for violating the #EndangeredSpeciesAct.

The agency proposed listing the SF Bay-Delta population of longfin smelt as an endangered species, but has failed to meet its deadline.

“The Fish and Wildlife Service needs to do its job and stick to the legal deadlines,” said Baykeeper's managing attorney, Eric Buescher. “As the Bay’s lawyers, Baykeeper is going to hold them accountable.”

Baykeeper Puts Federal Agency on Notice: Will Sue to Uphold Endangered Species Act

Fish and Wildlife Missed Congressional Deadline to Protect Longfin Smelt Oakland, California—San Francisco Baykeeper today put the US Fish and Wildlife Service on notice that the environmental advocacy organization intends to sue the agency for violating the Endangered Species Act (ESA). The agency proposed listing the SF Bay-Delta population of longfin smelt as an endangered species in 2022, but it has failed to meet a deadline established by Congress in the ESA to make a final listing determination or to designate what counts as critical habitat for the imperiled fish.
