On a patch of sidewalk on a busy industrial corridor in Newark, federal agents with rifles, metal batons, flak vests, and balaclavas faced off against unarmed activists with cardboard signs and a bullhorn. On Saturday, May 30, ICE Out of NJ organizers are inviting members of the press and public to gather outside Delaney Hall at 9 a.m.
What does it take to unionize factories today, especially in the South? In the last two years, bus manufacturing workers secured first union contracts and a national master agreement across New Flyer facilities in three states. Their strategy shows how, with pressure from transit agencies that buy the buses, union members from organized sites leading outreach to non-union workers, and fighting stewards on the line, workers can unionize plants across a whole company.

For years, both Uber and Lyft have insisted that their drivers are not their employees, but rather, independent contractors who therefore don’t qualify for minimum-wage and other such laws, and who cannot unionize under the terms of the National Labor Relations Act (NLRA). Their hard-fought position—roughly speaking, if it quacks like a duck, that still doesn’t make it a duck—immunized them from the normal duties of an employer (providing benefits, adhering to minimum-wage laws, and the like).
