So let's look at it in more detail, who did what back then, and how that would be handled today.
- The #ChiefPriests and #Scribes around #Caiaphas? They committed incitement. They incited the crowd to hatred of Jesus, to the point that they demanded crucifixion and tried to force Pilates' hand to avert a riot. In recent news, #JDVance in Feb 2025 complained about European countries having laws restricting "free speech" such as this. In other words, this crime of #incitement and spreading of dangerous #misinformation would be legal in today's United States, being considered protected #FirstAmendment activity. See also #January6 2021 and the discussions and non-action about the incitement that happened there.
- The criminal procedure against Jesus? See Mark 15:4-5 where Jesus kept silent on the accusations against him. Since #Salinas v. #Texas (2013) this isn't enough - Jesus didn't invoke his right to remain silent explicitly by not being silent. As such, the "court" could have used his silence against him. (This is just an interesting fact, as that didn't actually happen - Pilate convicted him anyway, but today it'd be even easier)
- What about the soldiers who performed the #crucifixion and the #flagellation preceding it? This would nowadays be considered covered by #QualifiedImmunity. Even if not, the soldiers could have expected a #PresidentialPardon (January 2025) from Herod and/or Pilates, depending on which level of the kingdom this would be handled at.
- Okay, so... #Pilates and #Herod? Wouldn't at least they have broken the law there? After all, Pilates himself admitted Jesus committed no crime, yet ordered the execution anyway. Well... that's what #PresidentialImmunity is for, ever since #Trump v. United States (2024), as clearly all those two did were official acts, simply because they acted using the powers they received by the "constitution" at the time. And even today the powers are similar enough (#SEALTeamSix). Note that I am fully OK with considering Pilates and Herod for "presidential immunity" as their actions were rather autonomous - #Tiberius likely neither knew or cared about these events.
- Fine... so what about... there must be someone who can be prosecuted here... #JudasIscariot? Good try. Not only did he suicide before he could be charged with anything, but even ignoring that, he may have had good chances for a presidential pardon. But none of that matters, as he'd have performed the betrayal via a #Signal chatroom anyway, this time without a journalist from #TheAtlantic (March 2025), thus there'd be no records and thus no crime to prosecute. #Signalgate
So... yes, today's United States, mostly but not exclusively due to the work by #MAGA, would totally have crucified the Savior. Tell me more how this is a "#Christian #nation"... #easter #uspol
