“Ci accusano di diffondere la falsa informazione che l’autonomia della magistratura dalla politica sarebbe a rischio perché “il principio di autonomia e indipendenza continua a essere scritto nella Costituzione”. È un argomento di una pochezza davvero sconcertante. Se bastasse che un principio sia scritto in una Costituzione, perché esso sia effettivo, allora avremmo risolto per sempre tutti i problemi. E infatti affermazioni di principio simili le rintracciamo senza vergogna nelle Costituzioni della Russia, dell’Iran, della Cina, della Corea del Nord e di decine di altri regimi autocratici“. Il costituzionalista e avvocato Enrico Grosso, presidente del comitato per il No al referendum promosso dall’Associazione nazionale magistrati, risponde così alle polemiche sui manifesti in cui si chiede agli elettori se vorrebbero “giudici dipendenti dalla politica“. “Se passa la riforma Nordio, la diminuzione dell’autonomia e dell’indipendenza della magistratura avverrà, perché si abbasseranno i presidi che quella autonomia e indipendenza garantiscono in concreto”, dice Grosso dall’assemblea di lancio della campagna del No a Roma, definendo gli attacchi della maggioranza e del fronte del Sì “scomposti e volgari“.
Nel suo intervento, il professore torinese sceglie poi di ringraziare “gli avvocati che si sono schierati per il No”: “Non è affatto vero che siano tutti a favore della separazione delle carriere”, sottolinea. Un passaggio non di circostanza. Perché un punto importante della strategia dei magistrati contro la riforma sarà ricordare il più possibile che anche “tanti avvocati”, come sostenuto stamattina da Grosso, sono contrari. La formazione di un comitato apposito per il No dei legali – raccontata già giorni fa dal Fatto – verrà evocata spesso per provare a non schiacciare la narrazione per il No sulla difesa dei giudici. “Sarebbe un errore”, si ragiona in ambienti dell’Anm. Proprio come i partiti progressisti, convinti che si debba sfuggire al rischio di far sembrare la campagna referendaria come la difesa di una categoria, o peggio di una “casta”.
