Over and over, DHS goons descend on areas where immigrants congregate,
grab every non-white person they encounter,
and drag them away with little regard for their citizenship status.

Then they send out indignant liars like DHS Assistant Secretary Tricia McLaughlin to spew nonsense about how this is all perfectly legal.

“Our officials use reasonable suspicion,” McLaughlin claimed on Fox News,
explaining the standard federal law enforcement officers use to detain people.

“That's protected under the US Constitution 4th Amendment."

❌ But none of that is true.

Unreasonable, improbable, illegal

The Department of Homeland Security ⚠️deliberately confuses "reasonable suspicion" and "probable cause"
in hopes that no one will notice that
💥ICE and CBP are making illegal arrests as standard operating procedure.

The #Fourth #Amendment guarantees that
the government cannot arrest a person without "probable cause to believe he or she committed a crime".

It requires a #warrant “supported by Oath or affirmation,
and particularly describing the place to be searched,
and the persons or things to be seized.”

Law enforcement officers are, however,
allowed to arrest someone without a warrant -- if they witness a crime taking place or in exigent circumstances where the suspect might flee.

In the 1968 case
"Terry v. Ohio",
the Supreme Court granted police the power to
“stop and frisk” people on the street
based on "reasonable suspicion"
— a lower standard than "probable cause".

In #Terry, a police officer in Cleveland observed three men appearing to case a store with the intent to rob it.

He approached the men,
patted them down,
found guns in their coats,
and arrested them for carrying illegally concealed weapons.

One defendant,
John Terry,
challenged the arrest claiming that being patted down violated the Fourth Amendment’s prohibition on unreasonable searches and seizures.

In an 8-1 ruling,
the Court held that being stopped and frisked by an officer who has reasonable suspicion of a crime is a “minor inconvenience and petty indignity.”

Justice #William O. #Douglas,
the lone dissenter,
warned that
“to give the police greater power than a magistrate
is to take a long step down the totalitarian path.”

And he was right.

#Terry #stops,
as they came to be known,
were weaponized against Black and brown people,
who are routinely accosted on the street by racist police.

But as bad as
"US v. Terry" is,
👍🔸it didn’t change the requirement that law enforcement officers must have "probable cause" to believe that a specific crime has been committed
— not just "reasonable suspicion"
— for an arrest.

And while DHS agents can take undocumented citizens into custody without a warrant,
⚠️they cannot simply grab people off the street,
throw them in the back of an unmarked vehicle,
and check their citizenship status later.

🆘 But ICE and CBP goons are doing just that, all day, every day,

🔥so DHS has resorted to simply lying about the Constitution itself.

Roma-Sassuolo 2-0, Kone and Soule' decide.

Roma beat Sassuolo at home after a long match dominated, especially in the second half, and after Ferguson’s early exit due to injury. Short of available central attackers, Gasperini brought Stephan El Sharawi to maneuver in front of Paulo Dybala and Mathias Soule'. At the 76th minute, it was Soule' who provided the assist for Manu Kone' to score the goal that unlocked the match. Three minutes later, a feint by El Sharawi freed up a shot for the same Soule' for the final 2-0.

Second consecutive success for Roma, which virtually climbs to third place in the league standings, pending the other matches of Serie A, with 39 points surpassing Napoli, fourth with 38 points and two games still to play. Second consecutive defeat for Sassuolo, which remains twelfth with 23 points. In the next round, the giallorossi will be on the road in Turin against Baroni’s granata, opponents of the capitolini also in the Coppa Italia this week. Sassuolo will be the host of Napoli on January 17th at the Maradona.

FA Cup, Macclesfield's fairytale: Palace eliminated in memory of the missing player.

AGI - On December 16th, Macclesfield, a sixth-tier English team, lost its 21-year-old striker Ethan McLeon in a road accident returning from an away match. Less than a month later, his teammates achieved one of the biggest feats in the history of the FA Cup, eliminating the holders, Crystal Palace, who play in the Premier League and are 117 places ahead. It’s one of those fairy tales that the English Cup often gifts, but this time it was born from a tragedy because McLeon’s parents were in the stands and the 5300 spectators dedicated two banners to him.

Macclesfield, a Manchester-based team coached by Wayne Rooney’s younger brother, John, deservedly reached the fourth round: after the goal by captain Paul Dawson in the 43rd minute, they doubled the lead in the 60th with Isaac Buckley-Ricketts. Palace shortened the gap with Yeremy Pino’s free kick in the 90th, but in the added time, the Silkmen (the team’s nickname) held on, sparking celebrations with a pitch invasion and players carried in triumph.

McLeon’s parents came down to celebrate with the team’s coach. “I told him he was definitely watching us today, I feel him being here with us,” Rooney said, “having them here meant so much.”

A curiosity: Macclesfield is the first ‘non-League’ (non-professional) team to eliminate the FA Cup holders since 1908-1909 when Crystal Palace itself beat Wolves in the first round.

The Gasperini team manages to untangle the situation at the 77th minute with Manu Koné and takes the lead with Soulé at 79’. First half: opportunities and injury

Good start for the Giallorossi with Dybala, after a combination with Soulé, warms up Muric’s gloves with a curled shot after five minutes. At 15’ Sassuolo almost takes the lead: Lipani’s pass launches I.Koné towards the goal, but Svilar blocks the path of the Canadian with a great low exit. The Neroverdi are dangerous again with Fadera, who at 24’ challenges Svilar with a right-footed shot on the first post. To close the first half, Gasperini loses Ferguson for a problem in the lower back and is forced to replace the Irishman at 39’ with El Shaarawy.

The second half and the goals of Koné and Soulé

In the second half, Rome starts with a different attitude and gets close to 1-0 at 53’ with Tsimikas, who misses the net from just a few steps after a shot by El Shaarawy deflected by Muric. The Giallorossi continue pressing, and at 77’ Manu Koné scores the lead for the hosts: Soulé’s cross from the left finds the French midfielder ready to head and beat Muric. Spaces open up, and Soulé doubles the score at 79’: the Argentine beats Muric from the edge of the area arriving in running on Ghilardi’s clearance. In the end, Rome manages the game, rightly taking the three points with a great second half.
