Clause-by-clause on Bill #C22 at SECU starts in five hours (3:30 Eastern Canada). Televised. https://www.ourcommons.ca/DocumentViewer/en/45-1/SECU/meeting-41/notice

The committee has given itself three hours. Witnesses are senior people from CSIS, Justice, Public Safety and the RCMP. I would expect questions to these witnesses to be limited to things like what the bill changes and how it would operate. They are obviously not people who are inclined to identify problems at clause-by-clause when the House wants to rise for the summer and they want these surveillance powers themselves. But also procedurally: clause-by-clause is about the text of the bill, not new evidence.

But also again: opposition members will try to derail through procedure. Points of order, points of privilege, motions, voice votes, whatever. It will waste time but ultimately they don't have the numbers to overturn the chair's rulings, as incorrect as they may be. Majority government rules.

Zero percent chance the clerk will have his ringer on.

In case of interest, a Parliamentary committee is hearing extra witnesses from 3:30 - 5:30 today on Bill C-22 ("lawful access"), because privacy advocates and tech companies and regular Canadians made such a stink about what the majority Liberals planned to do.

Witnesses include the Canadian Bar Association and Signal.

I can't imagine how Mark Carney's legal experts thought attempting to make a rights-depriving law retroactive would result in *less* litigation.

Hilariously, Bell's "Executive Office" has adopted my language by referring in writing to "Bell's Fraud/Legal Dept."

You know how courts (looking at you Supreme Court) manipulate history to get the outcome they want?

Well they manipulate science too.

Please check out my newest law review article which explores "law office science" in decisions on mifepristone and gender affirming care.

ANALYSIS | 6 key moments from the Supreme Court challenge of Quebec's secularism law | CBC News

Four days of hearings in the Supreme Court challenge to Quebec’s secularism law, Bill 21, are over. While the hearings dealt mostly with complex legal questions, there were some moments that revealed the intensity and passionate nature of the debates.

CBC

The Alberta government announced yesterday, March 20th, that it is closing Safe Consumption Sites (SCSs) in Calgary and Lethbridge.

The decision was based on an illegitimate study conducted by the Alberta government, and published under false pretenses in the journal "Addiction".

On March 13, Ford's Ontario government revealed (and announced on March 16) that they would be pulling funding from remaining provincially supported SCSs based on this one study.

On March 18, Manitoba premier Wab Kinew also walked back his decision to fast-track an SCS in Winnipeg seemingly based on the study.

And, MP Brad Redekopp demanded that Saskatchewan SCSs, which have never received provincial funding, have their federal licenses revoked based on the study also.

"The Court agreed with ARCH [Disability Law] and stated that the Tribunal improperly adopted a biomedical model of disability and did not engage in a socio-political analysis, which required assessing all the facts, not simply the nature of the impairment without context."

“The Court was clear that the Human Rights Tribunal of Ontario must not improperly close its doors to applicants as it seeks to manage its caseload,” said Michael Gottheil, Senior Counsel at ARCH and former Chair of the Human Rights Tribunal of Ontario.
