A Brussels appeals court Wednesday threw out a data protection challenge to transfers of Belgian Americans’ banking data to the US Internal Revenue Service under FATCA. But it may see the case again.
This study has collated evidence which on balance indicates a strong case to reform digital advertising. It indicates that the status quo is unsustainable for individuals, publishers and advertisers. Digital advertising that relies on the collection of personal data, tracking and massive-scale profiling can have unintended consequences on data protection rights, security, democracy and the environment. But there is little independent evidence to support claims that the use of extensive tracking and profiling yields a significant advantage compared to digital advertising models which don’t do this. This strengthens the position of players who have the most control over and insight into people’s behaviour online and weakens the ability of others, especially advertisers and publishers, to communicate directly to their customers. It has also created an accountability crisis, where individuals are expected to navigate a complex web of companies in order to control the types of ads they see online. This study points to gaps in the regulatory framework which could enable many of the issues highlighted to persist. There is a need to improve transparency and accountability, increase individuals’ control over how their personal data is used for digital advertising and address a number of obstacles that make it harder for advertisers and publishers to “know their audience”.

December has flown by with lots of fun festive extra activities on the mind, presents to buy and events to go to. 🎄
This means it's been easy to lose track of important developments in data protection - an area of law which continues to be busy all year round! 🧐
So whilst lots of us are winding down for a nice long holiday weekend, here are five significant events in December from a GDPR and UK GDPR perspective in case you missed them:
1️⃣ The EU Commission has proposed a draft EU - US Data Privacy Framework (the new 'privacy shield' ). However, whilst the draft is significant, the decision has not been finalized. The process which expected to take another 6 months.
2️⃣ The UK Information Commissioner published various important pieces including its Direct Marketing Guidance which has long been anticipated by the industry. The ICO also released a forward thinking piece called 'Tech Horizons' which examines the implications of some of the most significant technological developments for privacy in the next two to five years.
3️⃣ The EU has signed a declaration on EU digital rights and principles that highlights "the EU's commitment to a secure, safe and sustainable digital transformation." The declaration is wider than just protecting personal data including #ESG themes around sustainability and digital inclusion.
4️⃣ Microsoft plans to roll out a 'data boundary' for its EU customers from 1 January to help their customers comply with their commitments under the GDPR.
5️⃣ New draft texts has been released for significant EU legislation in the data space, including the upcoming #AI Act, and the EU Data Act.

Some key highlights include:
💭 A reminder of where we are now. The US has signed an Executive Order on 7 October to implement the agreement in principle announced in March.
📝 Next steps are with the EU Commission. In particular the European Data Protection Board will need to give an opinion, a committee of representatives will need to approve it and the EU Parlaiment will need to decide whether to scrutinise the decision.
🧐 What are the options for companies now? In summary, don't rely on the proposed Privacy Shield yet and keep using those other transfer mechanisms (SCCs etc.).
