US crypto law is starting to make an important distinction: intermediaries are not the same thing as self-custodial tools.

Reuters reports that the CLARITY Act would set a clearer federal market structure for digital assets, including a path for some networks to be treated as commodities once they are sufficiently decentralised. Reuters Practical Law also says the GENIUS Act includes peer-to-peer safe harbours and excludes distributed ledger protocols and self-custodial software interfaces from the DASP definition.

That does not solve everything, but it suggests lawmakers are slowly being forced to admit that open protocols and self-custody are not the same as custodial platforms.

Bitcoin Lightning is quietly moving into everyday payments.

Square has begun enabling Lightning payments for millions of merchants by default. No extra setup, just built in.

At the same time, tools like Boltz are enabling non-custodial swaps between Lightning and stablecoins without accounts or KYC.

So we now have two paths: • seamless mainstream adoption
• self-sovereign, privacy-first usage

Both are growing, but they don’t always align.

That’s the tension to watch. Convenience can easily come at the cost of control.
