Just finished Elie Mystal's podcast Contempt of Court. Really interesting and thought-provoking. Highly recommend it, if you're looking for something to listen to.

@TCatInReality What are you thinking on SCOTUS reform?

I don't think there's anything #biden can do unilaterally as a #lameduck (without support of both the house and senate).

My thoughts here are politically unpopular things #biden can do as a #lameduck that are the right things to do, but political suicide (i.e. anything pro-#Palestinian).

Some #courtpacking would be great, but as you suggest, after Kamala gets both house and senate majorities in 2025.

I "wishful think" too much.

But in practice, they are also constrained by norms & conventions. Since the early 20th century, for instance, #Congress has not dissolved #FederalCourts whose #judges displease it—which did happen in the more distant past. The idea of #CourtPacking has been considered out of bounds ever since #FDR tried & failed to reshape #SCOTUS in the 1930s by proposing to appoint up to 6 additional justices.

#law #PartisanCourt #ActivistCourt #illiberalism #criminal #extremism #corruption #SCOTUSreform

Idea for the day: #SCOTUS should be so large that it has its own panels/benches for specific types of cases. A constitutional bench, a criminal bench, an elections bench, an administrative law bench, etc. #CourtPacking #SupremeCourt #USSupremeCourt #USPol #USPolitics

If you aspire to be a Very Serious Person (and whomst amongst us doesn't?) then you know why we can't have nice things. The American people won't stand for #CourtPacking, Congressional #TermLimits, the abolition of the #ElectoralCollege, or #CampaignFinanceLimits. Politics is the art of the possible, and these just aren't possible.

Biden Is Wrong. The Supreme Court is Already “Politicized.”

President Biden said he won’t expand the Supreme Court because doing so would “politicize” the court in an unhealthy way. But it’s a political institution by its nature — and a disturbingly undemocratic one.

Democrats double down on eliminating filibuster, court packing

Just a reminder: Amy Coney Barrett would never have become an appellate judge if GOP Senate had confirmed President Obama's nominee Myra Selby, a Black woman, to Indiana seat on 7th Circuit in 2016. But GOP blocked Selby, kept seat open & Trump filled it w/Barrett. #CourtPacking
