La vignetta fu pubblicata il 9 gennaio, giornata di lutto nazionale in Svizzera in memoria delle vittime dell'incendio divampato in un bar di Crans-Montana la notte di Capodanno e costato la vita a 41 persone - per lo più adolescenti e tra questi 6 italiani - e il ferimento di altre 115.
La decisione dei giudici e la libertà di espressione
Secondo la procura, la vignetta è "stilizzata", "non realistica", non mostra atti espliciti di crudeltà o rappresentazioni di sofferenza e non costituisce, "di per sé", una rappresentazione di violenza. Inoltre, i giudici hanno stabilito che, sebbene la tempistica della pubblicazione possa aver "scioccato e offeso", "lo shock che questa vignetta può produrre non è sufficientemente intenso da nuocere alla salute mentale" delle vittime e dei testimoni della tragedia. "In Svizzera, come in Francia e in qualsiasi Paese civilizzato, un disegno non può essere equiparato alla violenza, e dobbiamo smetterla di fingere il contrario", ha dichiarato all'AFP l'avvocato di Charlie Hebdo, Richard Malka.
"Un disegno può essere scioccante, considerato di cattivo gusto, ma in ogni caso, dobbiamo smetterla di cercare di vietare, proibire e censurare tutto ciò che ci disturba. Questa non è una questione di competenza dei tribunali, ma della coscienza individuale".

The judges’ decision and freedom of expression
According to the prosecutor, the cartoon is “stylized,” “not realistic,” does not show explicit acts of cruelty or representations of suffering, and does not constitute, “in itself,” a representation of violence. Furthermore, the judges stated that, although the timing of the publication may have “shocked and offended,” “the shock that this cartoon can produce is not sufficiently intense to harm the mental health” of the victims and witnesses of the tragedy. “In Switzerland, as in France and in any civilized country, a drawing cannot be equated with violence, and we must stop pretending otherwise,” lawyer Richard Malka of Charlie Hebdo told AFP.
“A drawing can be shocking, considered bad taste, but in any case, we must stop trying to ban, prohibit, and censor everything that disturbs us. This is not a matter for the courts, but of individual conscience.”
